個人資料收集聲明

為施行«個人資料(私隱)條例»(下稱「條例」),邦民日本財務(香港)有限公司(下稱「邦民」)現向客戶發出此通知。

  1. 客戶就開立及/或延續貸款戶口、建立及/或延續信貸融通,及/或提供其他財務服務而言,需要不時向邦民提供個人資料。
  2. 若未能提供該等個人資料,可能會導致邦民無法開立或延續貸款戶口,建立或延續信貸融通,向客戶提供其他財務服務。
  3. 邦民在通常業務運作中,例如,當客戶以口頭或書面形式與邦民溝通時,亦會透過文書形式或邦民的電話錄音系統(視屬何種情況而定)向客戶收集個人資料。
  4. 客戶的個人資料可能會用於下列用途:
    • (a)貸款戶口、信貸融通及提供給客戶之其他財務服務之日常運作;
    • (b)在申請信貸時進行的信貸調查,及不時進行的定期或特別審查;
    • (c)編制及維持邦民的信貸評分模式;
    • (d)協助其他放債人及/或財務機構作信貸調查及追討債務;
    • (e)確保客戶維持可靠信用;
    • (f)設計供客戶使用的財務服務或有關產品;
    • (g)計算邦民與客戶之間的欠款;
    • (h)向客戶追收欠款;
    • (i) 按照以下各項,遵守適用於邦民或邦民被預期遵守的有關資料披露及使用的責任、規定或安排︰
      • (i)在目前或未來於香港特別行政區(下稱「香港」)境內或境外生效的對其具約束力或適用的任何法律;
      • (ii)任何法律、監管、政府、稅務、執法或其他機關,或財務服務供應商的自我監管或行業機構或組織所作出或頒布的,在目前或未來於香港境內或境外生效的任何指引或指導;及
      • (iii)因邦民在有關的本地或外地法律、監管、政府、稅務、執法或其他機關,或自我監管或行業機構或組織的管轄範圍內(或與此管轄範圍有關)的財務、商業、業務或其他權益或活動,而由邦民承擔或對邦民施加的與本地或外地法律、監管、政府、稅務、執法或其他機關,或財務服務供應商的自我監管或行業機構或組織之間的任何目前或未來的合約承諾或其他承諾;
    • (j)遵守有關於任何邦民之附屬公司、控股公司、聯營公司或關聯公司(下稱「邦民集團公司」)內的資料及資訊共享及/或資料及資訊的任何其他使用(有關共享及使用,均依照符合對洗錢、恐怖分子資金籌集或其他不法活動的制裁、防止或偵測的任何邦民集團公司的計劃而進行)的任何責任、規定、政策、程序、措施或安排;
    • (k) 使邦民的實際或建議承讓人,或邦民對客戶的權利的參與人或附屬參與人能評核意圖成為轉讓、參與或附屬參與的標的之交易;
    • (l)推廣邦民的財務服務或產品;及
    • (m)與上述各項有關的其他用途。
    在(a)至(k) (含兩者)段中列出的用途及與之相關的任何用途均屬「強制性」用途,意思是如客戶希望使用邦民的服務,客戶必須准許邦民將其個人資料用作該等用途。在(l)段中列出的用途及與之相關的任何用途均屬「自願性」用途,意思是客戶有權選擇邦民是否可將他們的資料用於該等用途,且若客戶不欲邦民將其個人資料用於該等用途,他/她可告知邦民而邦民不會將其個人資料用於該等用途。
  5. 邦民會對其持有的有關客戶的個人資料保密,但邦民可能會把該等資料提供給下述各方(不論在香港內外)作第4段列出的用途(全部均為強制性用途,惟第4(l)段除外)︰
    • (a) 向邦民提供行政、電訊、電腦、付款或其他與邦民業務運作有關的服務的任何代理人、承包人、或第三方服務供應者;
    • (b) 任何對邦民負有保密責任的其他人,包括已承諾對該資料保密的邦民集團公司成員公司;
    • (c)獲得客戶明示訂明同意的任何人;
    • (d)信貸資料服務機構,以及(在發生欠賬時)追討欠款公司;
    • (e)邦民有責任或在其他情況下須向其作出「有關披露」的任何人士;而「有關披露」是指︰對邦民具約束力或適用的任何法律的規定下的披露;或由任何法律、監管、政府、稅務、執法或其他機關,或財務服務供應商的自我監管或行業機構或組織所作出或頒布的邦民被預期遵守的任何指引或指導下及其所指的任何披露;或依據邦民與本地或外地法律、監管、政府、稅務、執法或其他機關,或財務服務供應商的自我監管或行業機構或組織之間的任何合約承諾或其他承諾的任何披露(以上各項可為於目前或未來在香港境內或境外生效者);
    • (f)用於直接促銷的選定人士(作為自願性用途) (請參閱下文第6段以了解進一步詳情);
    • (g)邦民為上文第4(l)段所載用途而聘用的外部服務供應商(包括但不限於郵寄公司、電訊公司及資訊科技公司);及
    • (h)邦民的任何實際或建議承讓人或邦民對客戶的權利的參與人或附屬參與人或受讓人。
  6. 邦民希望把客戶的個人資料用於直接促銷目的(作為自願性用途)。未經事前獲得他或她就該用途的書面同意(包括表示不反對),邦民不得將客戶的個人資料用於該用途。就此,請注意︰
    • (a)邦民可能把邦民不時持有的客戶姓名、聯絡資料、產品及服務組合資料、交易模式及行為、財務背景及人口統計數據用於直接促銷;及
    • (b)可用作促銷下列類別的服務、產品及促銷標的﹕
      • (i).財務相關的服務及產品;及
      • (ii).獎賞、客戶忠誠或優惠計劃及相關服務及產品。
    客戶有權選擇他們的個人資料是否可用於直接促銷目的。若客戶不欲邦民使用或向其他人士提供其個人資料以作上文所述的直接促銷用途,且希望邦民告知其他人士停止使用其個人資料以作有關的直接促銷目的,則該客戶可在任何其他時間向邦民告知此點(告知方式乃按下文第10段所述方式聯絡邦民的資料保障主任,或採用邦民認為可接受的其他方法)而無須付款。
  7. 根據及按照條例中的條款及根據條例發出的«個人信貸資料實務守則»,每名客戶有權︰
    • (a)查核邦民是否持有關於他/她的個人資料及查閱該等個人資料;
    • (b)要求邦民改正任何有關他/她的不準確的個人資料;
    • (c)查明邦民關於個人資料的政策及慣例和獲告知邦民持有的個人資料種類;
    • (d)就個人信貸而言,在提供要求的情況下獲告知向信貸資料服務機構或追討欠款公司例行披露的是哪些個人資料,及獲提供進一步資料以便向有關信貸資料服務機構或追討欠款公司提出查閱和改正資料的要求;及
    • (e)就邦民已提供予信貸資料服務機構的任何賬戶資料(包括賬戶還款資料)而言,於全數清還欠款而結束賬戶時,指示邦民要求該信貸資料服務機構從它的資料庫中刪除有關賬戶資料,惟是項指示須於結束賬戶後5年內提出,且該賬戶在緊接結束之前5年內須並無超過60天的拖欠付款記錄。「賬戶還款資料」包括上次的應付金額、上次報告期間(即緊接邦民上次向信貸資料服務機構提供賬戶資料前不超過31天的期間)所作付款額、剩餘可用信貸額或未償還結餘及欠款資料(即(i)過期欠款額及逾期還款日數、(ii)清還過期欠款的日期和(iii)最後清還拖欠超過60天的欠款(如有)的日期。
  8. 客戶應注意:
    • (a)如出現關於賬戶的拖欠還款情況,除非拖欠金額在由出現拖欠日期起計60天屆滿前全數清還或撇賬(因破產令導致除外),否則信貸資料服務機構可保留有關客戶賬戶還款資料,直至自欠款最後清還之日計滿5年為止;及
    • (b)如客戶因被頒布破產令而導致賬戶中的任何金額被撇賬,則不論其賬戶還款資料是否顯示有拖欠還款超過60天的記錄,信貸資料服務機構可保留該賬戶還款資料,直至(i)自欠款最後清還之日起計滿5年為止,或(ii)自客戶提出證據通知信貸資料服務機構其已獲解除破產令之日計滿5年為止(以較早發生者為準)。
  9. 根據條例的條款,邦民有權就處理任何查閱個人資料的要求收取合理費用。
  10. (i)關於查閱或改正個人資料,或索取關於邦民的個人資料收集聲明及所持有的資料種類的要求及(ii)關於使用/提供個人資料以作直接促銷的同意、反對及/或退出,應向下列人士提出︰

  11. 邦民在批核任何信貸申請及/或審閲或重續向客戶提供的現有信貸融通時,可能已從信貸資料服務機構獲得有關客戶的信貸報告。如邦民爲了審閲的目的而查閱該等個人信貸資料,其將會考慮的事項將是(i)信貸數額的增加、(ii)信貸的取消、(iii)信貸數額的減少或(iv)與相關客戶作出債務償還安排。在相關客戶欠繳款項期間,爲了對債項進行合理監察,邦民亦可查閱有關客戶的該等個人信貸資料。如客戶有意取閱該信貸報告,請直接聯絡環聯資訊有限公司,電話2577 1816。
  12. 本個人資料收集聲明不得限制客戶在條例下所享有的權利。
  13. 本個人資料收集聲明的英文及中文版本如出現歧異,則英文版本就一切目的適用及以之為準。

PERSONAL INFORMATION COLLECTION STATEMENT

Promise (Hong Kong) Co., Limited ("Promise") gives this notice to its customers for the purposes of the Personal Data (Privacy) Ordinance (the "Ordinance").

  1. From time to time, it is necessary for customers to supply Promise with personal data in connection with the opening and/or continuation of loan accounts, the establishment and/or continuation of credit facilities, and/or provision of other financial services.
  2. Failure to supply such personal data may result in Promise being unable to open or continue loan accounts, or establish or continue credit facilities, or provide other financial services to customers.
  3. It is also the case that personal data are collected from customers in the ordinary course of business of Promise, for example, when customers communicate verbally or in writing with Promise, by means of documentation or Promise's telephone recording system (as the case may be).
  4. The purposes for which customers' personal data may be used are as follows:
    • (a)the daily operation of loan accounts, credit facilities and other financial services provided to customers;
    • (b)conducting credit checks upon an application for credit and when regular or special reviews are conducted from time to time;
    • (c)creating and maintaining Promise's credit scoring models;
    • (d)assisting other money lenders and/or financial institutions to conduct credit checks and collect debts;
    • (e)ensuring ongoing credit worthiness of customers;
    • (f)designing financial services or related products for customers' use;
    • (g)determining amounts owed to or by customers;
    • (h)collection of amounts outstanding from customers;
    • (i)complying with the obligations, requirements or arrangements for disclosing and using data that apply to Promise or that it is expected to comply according to:
      • (i)any law binding or applicable to it within or outside Hong Kong Special Administrative Region (“Hong Kong”) existing currently or in the future;
      • (ii)any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Hong Kong existing currently or in the future; and
      • (iii)any present or future contractual or other commitment with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers that is assumed by or imposed on Promise by reason of its financial, commercial, business or other interests or activities in or related to the jurisdiction of the relevant local or foreign legal, regulatory, governmental, tax, law enforcement or other authority, or self-regulatory or industry bodies or associations.
    • (j)complying with any obligations, requirements, policies, procedure, measures or arrangements for sharing data and information within any of the subsidiaries, holding companies, associated companies or affiliates of Promise (the “Promise Group Companies”) and/or any other use of data and information in accordance with any Group-wide programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;
    • (k)enabling an actual or proposed assignee of Promise, or participant or sub-participant of Promise's rights in respect of customers to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation;
    • (l)marketing financial services or products of Promise; and
    • (m)other purposes relating to each of the above.
    The purposes listed in paragraphs (a) to (k) (inclusive) and any purposes related thereto are "obligatory" purposes, meaning that customers must permit Promise to use their personal data for these purposes if they wish to use Promise's services. The purposes listed in paragraph (l) and any purposes related thereto are "voluntary" purposes, meaning that customers have a choice whether Promise can use their data for these purposes and if a customer does not want Promise to use his/her personal data for those purposes, he/she can tell Promise and Promise will not use his/her personal data for those purposes.
  5. Personal data held by Promise relating to a customer will be kept confidential but Promise may provide such data to the following parties (whether within or outside Hong Kong) for the purposes set out in paragraph 4 (all obligatory purposes except paragraph 4(l)):
    • (a)any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or other services to Promise in connection with the operation of its business;
    • (b)any other person under a duty of confidentiality to Promise including a member of the Promise Group Companies which has undertaken to keep such information confidential;
    • (c)any person with the express prescribed consent of customers;
    • (d)credit reference agencies, and, in the event of default, debt collection agencies;
    • (e)any person to whom Promise is under an obligation or otherwise required to make disclosure under the requirements of any law binding on or applying to Promise, or any disclosure under and for the purposes of any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers with which Promise is expected to comply, or any disclosure pursuant to any contractual or other commitment of Promise with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers, all of which may be within or outside of Hong Kong and may be existing currently or in the future;
    • (f)as a voluntary purpose, selected persons for use in direct marketing (please see further details in paragraph 6 below);
    • (g)external service providers (including but not limited to mailing houses, telecommunication companies and information technology companies) that Promise engages for the purpose set out in paragraph 4(l) above; and
    • (h)any actual or proposed assignee of Promise or participant or sub-participant or transferee of Promise's rights in respect of the customers.
  6. Promise would like to use personal data of customers for direct marketing purposes as a voluntary purpose. Promise cannot use a customer's personal data for that purpose without first obtaining his or her written consent (which includes an indication of no objection) for that purpose. In this connection, please note that:
    • (a)The name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data of a customer held by Promise from time to time may be used by Promise in direct marketing; and
    • (b)the following classes of services, products and subjects may be marketed:
      • (i)financial related services and products; and
      • (ii)reward, customer loyalty or privileges programmes and related services and products
    Customers have a choice on whether or not their personal data can be are used for direct marketing purposes. If a customer does not wish Promise to use or provide to other persons his/her personal data for use in direct marketing as described above, and also wants Promise to advise other persons to stop using his/her personal data for such direct marketing purpose, such customer may notify Promise of the same (by contacting the Data Protection Officer of Promise as described in paragraph 10 below or such other method acceptable to Promise) at any other time, without charge.
  7. Under and in accordance with the terms of the Ordinance and the Code of Practice on Consumer Credit Data issued under the Ordinance, every customer has the right:
    • (a)to check whether Promise holds personal data about him/her and to have access to such personal data;
    • (b)to require Promise to correct any personal data relating to him/her which are inaccurate;
    • (c)to ascertain Promise's policies and practices in relation to personal data and to be informed of the kind of personal data held by Promise;
    • (d)in relation to consumer credit to be informed on request which items of personal data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of a data access and correction request to the relevant credit reference agency or debt collection agency; and
    • (e)in relation to any account data (including account repayment data) which have been provided by Promise to a credit reference agency, to instruct Promise upon termination of an account by full repayment to make a request to the credit reference agency to delete such account data from its database, as long as the instruction is given within 5 years of termination and at no time did the account have a default of payment lasting in excess of 60 days within the 5 years immediately before account termination. Such “Account repayment data” include amount last due, amount of payment made during the last reporting period (being a period not exceeding 31 days immediately preceding the last contribution of account data by Promise to a credit reference agency), remaining available credit or outstanding balance and default data (being (i) amount past due and number of days past due; (ii) date of settlement of amount past due; and (iii) date of final settlement of amount in default lasting in excess of 60 days (if any)).
  8. Customers should note that :
    • (a)in the event of any default in repayment relating to an account, unless the amount in default is fully repaid or written off (other than due to a bankruptcy order) before the expiry of 60 days from the date such default occurred, the account repayment data of the relevant customer may be retained by the credit reference agency until the expiry of 5 years from the date of final settlement of the amount in default; and
    • (b)if any amount in an account is written-off due to a bankruptcy order being made against a customer, the account repayment data may be retained by the credit reference agency, regardless of whether the account repayment data reveal any default of payment lasting in excess of 60 days, until the expiry of (i) 5 years from the date of final settlement of the amount in default; or (ii) 5 years from the date of discharge from bankruptcy as notified by the customer with evidence to the credit reference agency, whichever is earlier.
  9. In accordance with the terms of the Ordinance, Promise has the right to charge a reasonable fee for processing any personal data access request.
  10. The person to whom (i) requests for access to personal data or correction of personal data or for information regarding Promise's Personal Information Collection Statement and kinds of data held; and (ii) consents, objections and/or opt-outs in relation to the use/provision of personal data for direct marketing are to be addressed is as follows:

  11. Promise may have obtained a credit report on the customer from a credit reference agency in considering any application for credit and/or reviews or renewals of existing credit facilities to customers. The matters Promise will consider when accessing these consumer credit data for the purpose of reviews will be (i) an increase in the credit amount; (ii) cancellation of credit; (iii) a decrease in the amount of credit; or (iv) putting in place a scheme of arrangement with relevant customers. Promise may also access such consumer credit data about customers for the purpose of reasonable monitoring of indebtedness whilst relevant customers are in default.   12. Nothing in this Personal Information Collection Statement shall limit the rights of customers under the Ordinance.
  13. In case of discrepancies between the English and Chinese version of this Personal Information Collection Statement, the English version shall apply and prevail for all purposes.
