個人資料收集聲明

為施行個人資料(私隱)條例(下稱“條例”),邦民日本財務(香港)有限公司(下稱“邦民”)現通知貴客戶以下細則:

  1. 客戶在開立及/或延續信貸戶口、建立及/或延續信貸融通、及/或提供其他財務服務時,需要不時向邦民提供個人資料。
  2. 若未能提供該等個人資料可能會導致邦民無法開立或延續信貸戶口或建立或延續信貸融通或向客戶提供其他財務服務。
  3. 邦民在通常業務運作中,例如,當客戶以口頭或書面形式與邦民溝通時,邦民亦會收集客戶的個人資料,透過文書形式或邦民的電話錄音系統收集(視屬何種情況而定)。
  4. 客戶的個人資料可能會用於下列用途:
    • (a)提供信貸戶口、信貸融通及其他財務服務給客戶之日常運作;
    • (b)在申請信貸時進行的信貸調查,及不時進行的定期或特別審查之時;
    • (c)編制及維持邦民的信貸評分模式;
    • (d)協助其他放債人及/或財務機構作信用檢查及追討債務;
    • (e)確保客戶維持可靠信用;
    • (f)設計為客戶使用的財務服務或有關產品;
    • (g)計算邦民與客戶之間的債務;
    • (h)向客戶及為客戶的責任提供抵押的人士追收欠款;
    • (i)邦民為履行任何對其有約束力的法例的規定而作出披露;或為依循及施行任何預期邦民會遵從的監管或其他機構所發出的指引而作出披露;
    • (j)使邦民的實在或建議承讓人,或邦民對客戶的權利的參與人或附屬參與人評核意圖成為轉讓,參與或附屬參與的標的之交易;及
    • (k)推廣邦民的財務服務或產品;及
    • (l)與上述各項有關的用途。
    在(a)至 (j)(含兩者)段中列出的用途及在上述(l)段項下的相關用途屬「強制性」,意思是如客戶希望使用邦民的服務,客戶必須准許邦民將其個人資料用作該等用途。 在(k)段中列出的用途及在上述(l)段項下的相關目的屬「自願性」,意思是客戶有權選擇邦民是否可將他們的資料用於該等用途。
  5. 邦民會對其持有的客戶的個人資料保密,但邦民可能會把該等資料提供給下述各方(不論在香港內外)作第4段列出的用途:
    • (a)任何代理人、承包人、或向邦民提供行政、電訊、電腦、付款或其他與邦民業務運作有關的服務的第三方服務供應者;
    • (b)任何對邦民有保密責任的人,包括邦民內已承諾保持該資料保密的公司;
    • (c)獲得客戶訂明同意的任何人;
    • (d)信貸資料服務機構;而在客戶欠賬時,則可將該等資料提供給追收公司;
    • (e)邦民在根據對邦民具法律約束力的規定下或為依循及施行任何預期邦民會遵從的監管或其他機構所發出的指引而有責任對任何人作出披露;及
    • (f)邦民的任何實在或建議承讓人或就邦民對客戶的權利的參與人或附屬參與人或受讓人。
  6. 邦民希望把客戶的個人資料用於直接促銷目的。未經事前獲得他或她的同意(可包括表示不反對),邦民不得將客戶的個人資料用於該等用途。就此,請注意﹕
    • (a)邦民可能把邦民不時持有的客戶姓名、聯絡資料、產品及服務組合資料、交易模式及行為、財務背景及人口統計數據用於直接促銷;
    • (b)可用作促銷下列類別的服務、產品及促銷標的﹕
      • (i).財務相關的服務及產品;及
      • (ii).獎賞、客戶忠誠或優惠計劃及相關服務及產品。
    客戶有權選擇他們的個人資料是否用於直接促銷目的。如客戶在任何時間同意他或她的個人資料用於直接促銷但後來他/她改變主意他或她有權免費按下文第10段中所提供的地址或傳真號碼致函資料保障主任,或以邦民可接受的任何其他方式,通知邦民他/她不再希望邦民將他/她的個人資料用於直接促銷。
  7. 根據條例中的條款及根據條例發出的個人信貸資料實務守則,每名客戶有權:
    • (a)查核邦民是否持有他的個人資料及查閱該等個人資料;
    • (b)要求邦民改正任何有關他的不準確的個人資料;
    • (c)查明邦民關於個人資料的政策及慣例和獲告知邦民持有的個人資料種類;
    • (d)查詢並獲邦民回覆,例行向有關信貸資料服務機構或追收公司披露的是哪些個人資料,及獲邦民提供進一步資料,以便向有關信貸資料服務機構或追收公司提出查閱和改正資料的要求;
    • (e)於全數清還欠款而結束賬戶時,指示邦民要求該信貸資料服務機構,從它的資料庫中刪除邦民曾經向它提供的個人資料,惟是項指示須於結束賬戶後5年內提出,而該賬戶在緊接結束之前5年內,並無拖欠超過60天的記錄。該資料包括上次到期的還款額、上次報告期間所作還款額(即緊接邦民上次向該信貸資料服務機構提供戶口資料前不超過31天的期間)、剩餘可用信貸額或未償還數額及欠款資料(即過期欠款額及逾期還款日數、清還過期欠款的日期和全數清還拖欠超過60天的欠款的日期(如有))。
  8. 客戶應注意:
    • (a)如出現關於賬戶拖欠還款情況,除非拖欠金額在由出現拖欠日期起計60天屆滿前全數清還或撇賬(因破產令導致除外),否則信貸資料服務機構可保留賬戶還款資料,直至自欠款全數清還之日計滿5年為止;及
    • (b)如客戶因被頒布破產令而導致其賬戶中的任何金額被撇賬,則不論其賬戶還款資料是否顯示有拖欠還款超過60天的記錄,信貸資料服務機構可保留該賬戶還款資料,直至自欠款全數清還之日起計滿5年為止,或自客戶提出證據通知信貸資料服務機構其已獲解除破產令之日計滿5年為止(以較早發生者為準)。
  9. 根據條例的條款,邦民有權就處理任何查閱個人資料的要求收取合理費用。
  10. (i)任何關於查閱或改正個人資料,或索取關於邦民的個人資料收集聲明及所持有的資料種類及(ii)關於將個人資料用於直接促銷的通知的要求,應向下列人士提出:

  11. 邦民在批核任何信貸申請及/或審閲或續發向客戶提供的現有信貸融通時,可能從信貸資料服務機構獲得有關客戶的信貸報告。如邦民爲了審閲的目的而查閱客戶的該等消費者信貸報告,其將會考慮的事項將是信貸數額的增加、信貸的取消、信貸數額的減少或與相關客戶作出債務償還安排。在客戶欠繳款項期間,爲了對債項進行合理監察,邦民亦可查閱有關客戶的該等消費者信貸報告。如客戶有意取閱該信貸報告,請直接聯絡環聯資訊有限公司,電話2577 1816。
  12. 本個人資料收集聲明不得限制客戶在條例下所享有的權利。
  13. 本個人資料收集聲明的英文及中文文本如出現歧異, 則英文文本就一切目的而言應予以適用及施行。

PERSONAL INFORMATION COLLECTION STATEMENT

Promise (Hong Kong) Co., Limited ("Promise") gives this notice to its customers for the purposes of the Personal Data (Privacy) Ordinance (the "Ordinance").

  1. From time to time, it is necessary for customers to supply Promise with personal data in connection with the opening and/or continuation of loan accounts, the establishment and/or continuation of credit facilities, and/or provision of other financial services.
  2. Failure to supply such personal data may result in Promise being unable to open or continue loan accounts, or establish or continue credit facilities, or provide other financial services to customers.
  3. It is also the case that personal data are collected from customers in the ordinary course of business of Promise, for example, when customers communicate verbally or in writing with Promise, by means of documentation or Promise's telephone recording system (as the case may be).
  4. The purposes for which customers' personal data may be used are as follows:
    • (a)the daily operation of loan accounts, credit facilities and other financial services provided to customers;
    • (b)conducting credit checks upon an application for credit and when regular or special reviews are conducted from time to time;
    • (c)creating and maintaining Promise's credit scoring models;
    • (d)assisting other money lenders and/or financial institutions to conduct credit checks and collect debts;
    • (e)ensuring ongoing credit worthiness of customers;
    • (f)designing financial services or related products for customers' use;
    • (g)determining amounts owed to or by customers;
    • (h)collection of amounts outstanding from customers and those providing security for customers' obligations;
    • (i)meeting the requirements to make disclosure under the requirements of any law binding on Promise and for the purposes of any guidelines issued by regulatory or other authorities with which Promise is expected to comply;
    • (j)enabling an actual or proposed assignee of Promise, or participant or sub-participant of Promise's rights in respect of customers to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation;
    • (k)marketing financial services or products of Promise; and
    • (l)purposes relating to each of the above.
    The purposes listed in paragraphs (a) to (j) (inclusive) and related purposes under paragraph (l) above are "obligatory", meaning that customers must permit Promise to use their personal data for these purposes if they wish to use Promise's services. The purposes listed in paragraph (k) and related purposes under paragraph (l) above are "voluntary", meaning that customers have a choice whether Promise can use their data for these purposes.
  5. Personal data held by Promise relating to a customer will be kept confidential but Promise may provide such information to the following parties (whether within or outside Hong Kong) for the purposes set out in paragraph 4:
    • (a)any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or other services to Promise in connection with the operation of its business;
    • (b)any other person under a duty of confidentiality to Promise including a group company of Promise which has undertaken to keep such information confidential;
    • (c)any person with the express prescribed consent of customers;
    • (d)credit reference agencies, and, in the event of default, debt collection agencies;
    • (e)any person to whom Promise is under an obligation to make disclosure under the requirements of any law binding on Promise under and for the purposes of any guidelines issued by regulatory or other authorities with which Promise is expected to comply; and
    • (f)any actual or proposed assignee of Promise or participant or sub-participant or transferee of Promise's rights in respect of the customer.
  6. Promise would like to use personal data of customers for direct marketing purposes. Promise cannot use a customer's personal data for these purposes without first obtaining his or her consent (which can include an indication of no objection). In this connection, please note that:
    • (a)the name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data of a customer held by Promise from time to time may be used by Promise in direct marketing;
    • (b)the following classes of services, products and subjects may be marketed:
      • (i)financial related services and products; and
      • (ii)reward, customer loyalty or privileges programmes and related services and products
    Customers have a choice whether or not their personal data are used for direct marketing purposes. If a customer at any time consents to the use of his or her personal data for direct marketing but then changes his/her mind, he or she has the right, without charge, to notify Promise that he/she no longer wishes Promise to use his/her personal data in direct marketing by writing to the Data Protection Officer at the address or fax number provided in paragraph 10 below or any other method acceptable to Promise.
  7. Under and in accordance with the terms of the Ordinance and the Code of Practice on Consumer Credit Data issued under the Ordinance, every customer has the right:
    • (a)to check whether Promise holds personal data about him and to have access to such personal data;
    • (b)to require Promise to correct any personal data relating to him which are inaccurate;
    • (c)to ascertain Promise's policies and practices in relation to personal data and to be informed of the kind of personal data held by Promise;
    • (d)to be informed on request which items of personal data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of a data access and correction request to the relevant credit reference agency or debt collection agency; and
    • (e)in relation to personal data which have been provided by Promise to a credit reference agency, to instruct Promise upon termination of an account by full payment to make a request to the credit reference agency to delete such personal data from its database, as long as the instruction is given within 5 years of termination and at no time did the account have a default of payment lasting in excess of 60 days within 5 years immediately before account termination. Such account repayment data include amount last due, amount of payment made during the last reporting period (being a period not exceeding 31 days immediately preceding the last contribution of account data by Promise to a credit reference agency), remaining available credit or outstanding balance and default data (being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in default lasting in excess of 60 days (if any)).
  8. Customers should note that :
    • (a)in the event of any default in repayment, unless the amount in default is fully repaid or written off (other than due to a bankruptcy order) before the expiry of 60 days from the date such default occurred, the account repayment data may be retained by the credit reference agency until the expiry of 5 years from the date of final settlement of the amount in default; and
    • (b)if any amount in an account is written-off due to a bankruptcy order being made against a customer, the account repayment data may be retained by the credit reference agency, regardless of whether the account repayment data reveal any default of payment lasting in excess of 60 days, until the expiry of 5 years from the date of final settlement of the amount in default or the expiry of 5 years from the date of discharge from bankruptcy as notified by the customer with evidence to the credit reference agency, whichever is earlier.
  9. In accordance with the terms of the Ordinance, Promise has the right to charge a reasonable fee for processing any personal data access request.
  10. The person to whom (i) requests for access to personal data or correction of personal data or for information regarding Promise's Personal Information Collection Statement and kinds of data held and (ii) notifications about use of personal data for direct marketing are to be addressed is as follows:

  11. Promise may have obtained a credit report on the customer from a credit reference agency in considering any application for credit and/or reviews or renewals of existing credit facilities to customers. The matters Promise will be considering if accessing these consumer credit data for the purpose of reviews will be an increase in the credit amount, cancellation of credit, a decrease in the amount of credit or putting in place a scheme of arrangement with relevant customers. Promise may also access such consumer credit data about customers for the purpose of reasonable monitoring of indebtedness whilst relevant customers are in default.   12. Nothing in this Personal Information Collection Statement shall limit the rights of customers under the Ordinance.
  13. In case of discrepancies between the English and Chinese version of this Personal Information Collection Statement, the English version shall apply and prevail for all purposes.
